This seminar, recorded January 18, 2020 discusses the importance of an attorney having an obligation to have tech competence in the practice of law.
38 States have adopted a duty of tech competence obligation on the part of their attorneys. The ABA’s Model Rules of Professional Conduct specifies that a lawyer’s duty of competence includes competence in technology. Comment 8 to Model Rule 1.1 provides: “To maintain the requisite knowledge and skill, a lawyer should keep abreast of changes in the law and its practice, including the benefits and risks associated with relevant technology.”
State Bar Formal Opinion No. 2015-193 requires attorneys involved in litigation matters to have competence in e-discovery or associate with consultants of counsel who do have the competence.
